Welcome to Zephra.ca (the “Website”). By accessing, browsing, or purchasing from this Website, you agree to be bound by these Terms of Service, Legal Agreement, and Privacy Policy (collectively, the “Terms”). Please read them carefully. If you do not agree, do not use the Website.

1. General Use of Website

  • Must be of age of majority in your province/territory to use or make purchases.
  • Do not misuse the Website (fraud, reselling without permission, spamming, hacking, reverse-engineering).
  • Zephra reserves the right to suspend or terminate access for misuse.

2. Product Information & Pricing

  • Prices in Canadian dollars; international pricing may vary due to taxes, fees, and exchange rates.
  • Customers responsible for customs, import fees, and overseas surcharges.
  • Zephra may change pricing, descriptions, or availability at any time without notice.

3. Orders & Payment

  • Orders may be refused, canceled, or refunded at Zephra’s discretion.
  • Payments processed through third-party providers; Zephra not responsible for errors, delays, fraud, or disputes.
  • Custom orders are final sale unless otherwise stated.

4. Shipping & Delivery

  • Delivery times are estimates only.
  • Zephra not responsible for delays caused by carriers, customs, strikes, natural disasters, or Force Majeure.
  • Risk of loss passes to customer once shipped.

5. One-Year Limited Warranty

  • Covers manufacturer defects only; excludes misuse, accidents, wear and tear, unauthorized modifications, or shipping damage.
  • Claims must be submitted individually to zephra.help@gmail.com and reviewed case by case.
  • Zephra may approve or deny claims at its discretion.
  • Customers pay shipping for warranty claims; replacements for same product only.

6. Returns & Refunds

  • All sales final unless otherwise agreed.
  • Custom/personalized products non-refundable.
  • Refunds, if approved, limited to original purchase price; shipping and fees excluded.
  • Customers bear return shipping risk and costs.

7. Intellectual Property

  • All content (designs, text, images, graphics, trademarks, logos) is property of Zephra Canada unless noted.
  • Unauthorized reproduction, resale, or distribution prohibited.
  • Customers may not claim ownership of Zephra IP or branding.

8. User-Generated Content

  • Reviews, photos, or comments must be lawful, accurate, and non-offensive.
  • By submitting content, you grant Zephra a worldwide, royalty-free license to use or remove it.
  • Zephra not responsible for user-submitted content.

9. Disclaimers & Limitation of Liability

  • Use of Website and products is at your own risk.
  • No guarantees beyond the one-year limited warranty.
  • Zephra not responsible for direct, indirect, incidental, or consequential damages.
  • Maximum liability is original purchase price.

10. Dispute Resolution

  • Submit disputes first to zephra.help@gmail.com.
  • Unresolved disputes handled exclusively in Ontario, Canada under Ontario law.
  • Waiver of class action; disputes are individual.
  • Arbitration may be required at Zephra’s discretion.

11. Prohibited Uses

Users may not:

  • Engage in fraud, chargebacks, or false claims.
  • Interfere with Website operations or networks.
  • Bypass security systems or reverse-engineer software.
  • Use products for unlawful purposes.

12. Force Majeure

  • Zephra not liable for delays or failures caused by events beyond our control (natural disasters, strikes, pandemics, supply shortages, government restrictions, carrier failures).

13. Severability

  • If any provision is unenforceable, the remaining provisions remain in effect.

14. Entire Agreement

  • These Terms, with all posted policies, constitute the entire agreement between you and Zephra.

15. Changes to Terms

  • Zephra may update these Terms at any time; continued use constitutes acceptance.

16. Governing Law

  • These Terms governed by laws of Ontario and Canada.

17. Privacy Policy

17.1 Information We Collect

  • Personal: name, email, shipping/billing addresses, phone number, payment details.
  • Account: login credentials.
  • Transaction info: order history, warranty claims.
  • Technical info: IP, device/browser, browsing activity.
  • Cookies & tracking info.

17.2 How We Use Information

  • Process/deliver orders.
  • Provide warranty service.
  • Communicate order updates.
  • Improve website/services.
  • Prevent fraud/security issues.
  • Comply with Canadian law.

17.3 Sharing Information

  • We do not sell personal data.
  • Shared only with payment processors, shipping providers, service providers, and legal authorities if required.

17.4 Data Storage & Security

  • Stored securely per PIPEDA.
  • Payment info encrypted; full credit card numbers not stored.
  • SSL, restricted access, and monitoring protect data.

  • Updates to Privacy Policy effective upon posting; continued use constitutes acceptance.
